Legal Bases for Processing
We process your personal data under the following legal bases as defined in GDPR Article 6:
Performance of a Contract — Processing necessary to fulfill merchandise orders, manage customer accounts and process music submissions.
Legitimate Interests — Website analytics to improve our service, streaming analytics for royalty reporting obligations, and fraud prevention.
Legal Obligation — Retention of financial and transaction records for tax compliance and royalty reporting to SoundExchange, ASCAP, BMI, SESAC and SOCAN as required by our streaming licenses.
Consent — Where you have provided explicit consent such as signing up for communications.
Data We Collect
We collect the following personal data from European users:
- Name and email address
- Billing and shipping address
- Payment information (processed by PayPal — we never store card details)
- Website usage data via Google Analytics (anonymized)
- Streaming session data via Live365 including country of origin and listening hours
- Music submission files and artist information where provided
How We Use Your Data
- To process and fulfill merchandise orders
- To manage your customer account
- To send order confirmations and shipping updates
- To evaluate music submissions for airplay consideration
- To analyze website and streaming traffic to improve our service
- To fulfill royalty reporting obligations to music rights organizations
International Data Transfers
Your personal data may be transferred to and processed in the United States and other countries outside the EEA. These transfers are made under European Commission Standard Contractual Clauses with our service providers including:
- Google Analytics — website analytics
- Stripe/PayPal — payment processing
- Printful — merchandise fulfillment (with facilities in Latvia, Spain and the UK)
- Live365 — streaming platform and listener analytics
- SoundExchange, ASCAP, BMI, SESAC, SOCAN — music royalty reporting
Data Retention
We retain your personal data for the following periods:
- Customer account data — for as long as your account remains active
- Order and financial records — minimum 7 years for US tax compliance and up to 10 years for German commercial law (HGB) compliance
- Analytics data — 26 months per Google Analytics default retention settings
- Streaming analytics — minimum 3 years for SoundExchange royalty audit requirements
- Music submission files — 90 days after review then permanently deleted unless added to rotation
- Marketing communications — until you unsubscribe, after which deleted promptly
